Initially, the distinction between evading arrest and escape turns on whether or not the offender is in custody prior to his efforts to flee. If a peace officer is merely seeking to arrest the offender but has not accomplished the traditional steps to consummate the arrest, then an evading arrest charge is appropriate. Once the officer has taken the suspect into custody for no matter how brief a time any flight thereafter will be viewed as an escape. If the offender uses force against the officer in an effort to thwart the officer's labor to accomplish the arrest, the additional charge of resisting arrest is warranted.
