A lease gives the tenant an interest in real estate good even against the owner of the property. There are several statutory and common law protections that occur as a matter of law and many cannot be varied even if the lease states they can. Even a breaching tenant (i.e., has not paid the rent) has rights to occupancy until the landlord complies with legal requirements to evict (unlawful detainer).
