Police officers generally are afforded the same rights, privileges, and immunities outlined in the U.S. Constitution for all citizens. These rights are the basis for such legislation as the Peace Officers Bill of Rights (POBR), which is to protect police officers from undue or coercive police investigations, discussed next), labor agreements, court decisions, and civil service and departmental rules and regulations that guide an agency’s disciplinary process. POBR statutes ensure that police officers are not subjected to coercive interrogations or questioning. Additionally, most POBRs contain language that requires the department to provide a written notice of charges; they provide that officers have a right to representation, either an attorney or a union representative; they prohibit the use of a polygraph; and they often establish procedures specifying how the information obtained in an interrogation can be used. Specific rights include the freedom of speech, the Fourth Amendment protection against unreasonable searches and seizures, the right to privacy, the privilege against self-incrimination, and religious practices.
