A second prosecution by the same government against the same person for the same crime (or for a lesser included offense) once the first prosecution is totally finished and decided would be double jeopardy, and would not be permissible. The Double Jeopardy Clause is found in the Fifth Amendment to the United States Constitution, which provides: “no person shall be subject for the same offense to be twice put in jeopardy of life or limb.” The Clause is applied to the states through the Fourteenth Amendment.
