In Giles (2008), the Supreme Court held that an allegation of wrongdoing did not deprive a defendant of his Constitutional Right to Confrontation under the Sixth Amendment. Since the "reliable hearsay" exception had also been struck down, testimony could not be used against a person at trial if the statements came from the deceased.
