Under what circumstances is withdrawal a defense to solicitation?
What will be an ideal response?
The MPC allows such a withdrawal as a defense, if it is complete and voluntary. However, the courts are split as to whether this is a defense to the crime. The crime of solicitation basically involves spoken or written words. The crime is complete if the defendant expresses his or her thoughts with the specific intent that the other party commit the offense.
