What will be an ideal response?


Student responses should include discussion of arguments in favor of the exclusionary rule that point to the potential to weaken Fourth Amendment protections and that failing to recognize the constitutional status of the rule would be to give a right but withhold its privilege and enjoyment. For arguments against the exclusionary rule, students should include that it is a judicially created remedy intended to deter police misconduct—not a constitutionally required remedy—and as such, a judge is free to limit or even abolish it.
