May an injured worker receive workers’ compensation benefits for facial disfigurement? When would such an award be authorized?
What will be an ideal response?
Most states allow an injured worker to recover for facial disfigurement. What they do is to allow the parties or the judge to determine an amount to compensate the employee for the disfigurement and then refer to the schedules for the loss of other parts of the body. The final award would include an amount for the disfigurement and an amount from the loss. In some cases, the Workers’ Compensation Board might rule that a person is so disfigured by an injury that for all practical purposes the employee has sustained a permanent partial disability and make an award on that basis.
