Answer: 38 states and the District of Columbia have statutes establishing a civil order specific to protect stalking victims. However, violation of the stalking protection order is usually a misdemeanor criminal offense that carries some small amount of incarceration and or fines. States like Georgia and Virginia are not specific regarding the violation of these orders being in civil or criminal contempt. New York is the only state that does not list any penalties for violating stalking protection orders.
