When the testator has made a new will and destroyed the old one believing it to have been revoked, but then it is discovered that the new will is void. In that circumstance the old, canceled will is considered valid. The presumption is that the testator would not have canceled the original will but for the belief that the new one was valid. This doctrine is used to avoid the problem of intestacy. In today’s time, people shred old documents making the application of this doctrine very difficult.
