In the most general sense, intestacy succession occurs when a person dies without a valid will, or without a will at all. Each state then has their own set of intestacy laws for the disbursement of the property. Disbursement is determined through relationships based on next of kin, and people may be related lineally, collaterally, or through affinity. Once family lineage is established the property must then be determined to be community or separate, before it can be distributed.
