What is the difference between a breach of contract claim and a bad faith claim?

All contracts have an implied covenant of good faith and fair dealing, which requires the parties to fulfill their obligations under the contract honestly, fairly, reasonably, and in good faith. Courts have held in some circumstances where there is a special relationship between the parties that breach of the covenant of good faith and fair dealing is a tort called bad faith, which can be pursued by the nonbreaching party. Damages for bad faith go beyond the expectancy damages awarded in contract law. Bad faith damages include the full range of tort damages including punitive damages and damages for emotional distress and loss of consortium.
