The attacker must possess the power to kill or inflict crippling injury (suspect has a weapon that can be used to inflict this injury. Opportunity: The attacker must be capable of immediately employing that power in an attack (the suspect is within proximity to affect an injury/death to another). Jeopardy: The attacker must act in a manner that a reasonable and prudent person would conclude that the attacker has intent to kill or inflict crippling injury (he/she has a weapon and is within proximity to do so and will if not stopped). Examples can include suicide by cop situations or school shootings where suspects have a handgun, are around many people and close enough to inflict serious bodily injury.
