According to the Model Rules and the Model Code, if the check she received was a “cut” of
her lawyer’s fee, then it would be an inappropriate fee-sharing payment. Rule 1-320 of the
California Rules of Professional Conduct has a nonlawyer fee-sharing prohibition that is
similar to the Model Rules’ and Model Code’s prohibitions, with similar exceptions.
However, there is a 1989 ethics opinion (Op. 457) from the Los Angeles County Bar
Association that states a lawyer may pay a paralegal a bonus in recognition of excellent
performance on a case or a series of cases, as long as the bonus does not involve the sharing
of legal fees.
