You are preparing to train new police officers on the use of force. Using the Graham factors, explain how a court will look at the reasonableness of force used by a police officer. Also provide an example to your class of a failure to meet the standard
What will be an ideal response?
The reasonableness of force used must be judged from the perspective of the officer on the scene, rather than with the 20/20 vision of hindsight. The courts will view the force incident and evaluate the severity (dangerousness) of the crime at issue, if there is an immediate threat to the officer or others, and whether or not the suspect is actively resisting or attempting to evade arrest by flight. The student should be able to come up with a brief scenario in which an officer did not meet one or all of the standards.
