A. fiduciary duty
A fiduciary duty is a physician's obligation to his or her patient, based on trust and confidence. By giving consent, the patient gives permission, either expressed (orally or in writing) or implied, for the physician to examine him or her, to perform tests that aid in diagnosis, and/or to treat for a medical condition. A caring relationship is beneficial to the patient, but is not the fiduciary duty of the physician. Informed consent ensures that the patient understands the types of treatment and alternatives. The Good Samaritan Act protects providers from charges of negligence if they stop to help the victim in an emergency.
