Explain the exclusionary rule and the exceptions to the exclusionary rule.
What will be an ideal response?
The exclusionary rule states that if a search is deemed to be unreasonable, the evidence obtained must be excluded from trial. However, there are exceptions to the exclusionary rule, that is, instances where evidence that would technically be considered illegal are still admissible as evidence. Exceptions include good faith—when police make an unintentional error in conducting the search; inevitable discovery—when the police would have found the evidence without the illegal search; purged taint—when the voluntary actions of the suspect nullify the illegal actions of the police; independent source—when evidence is obtained independent of the illegal police action.
