Competency refers to whether or not a person is able to understand the charges and is able to assist in his/her own defense. The courts have ruled that people cannot be considered incompetent indefinitely and that after a reasonable amount of time, they must be found competent and tried or incompetent and set free. However, it has proved difficult to make this determination in many cases.
