There are several methods for taking the formal witness statement. List and describe the three types of formal witness statements discussed in this chapter.

What will be an ideal response?


a. Deposition—The deposition is a recorded statement of the witness by counsel, and the
witness is subject to penalties of perjury. The testimony is transcribed by a professional
reporter or by an audio or video recording.
b. Affidavit—An affidavit is either an oral statement made under oath and transcribed by a
professional reporter or a written statement made under oath in the presence of a notary
public.
c. Declaration—A declaration is a written statement about the matter at hand. It is prepared
and signed by the witness and must include a disclaimer that the statement was made
voluntarily and under the penalty of perjury.
