• Several states absolutely prohibit the use of prior sexual behavior of the victim as evidence, or prohibit the use as evidence of prior sexual behavior of the victim unless it was with the defendant.
• These character-limited statutes are called rape shield laws.
• When they first enacted, these laws were strictly enforced but there have been court case decisions easing the impact of some of these statutes as where a defendant needs to introduce evidence that the alleged victim is a prostitute or that the victim as falsely accused others in the past of rape.
