Explain the concept of duty as applied to civil cases

Before you can recover in a tort action, you must establish damages, caused by defendant, and a breach of duty. For example anyone driving an automobile on a public road has a duty to drive carefully. Thus, to recover you must establish that the defendant breeched that duty. If a child is drowning and an onlooker makes no attempt to save the child, the onlooker is not civilly liable for death unless the onlooker had a duty to protect the child such as a parent, guardian, or carekeeper.
