Though the obligation to maintain confidentiality in the patient–therapist relationship is fundamental, when the court asks a clinician to conduct an evaluation, the clinician’s client is the court, not the individual being examined. The results of the evaluation are shared among the judge and the lawyers and may be discussed in the open courtroom if the clinician is called to the stand. Even the confidentiality of test data is not guaranteed if the client signs a release or if the court orders that it be released.
