First, the plaintiff does not have the responsibility of making arrangements to invest the money if the plaintiff receives periodic payments over a long period of time. Money will be available to cover basic human needs. Second, a large amount of the money will be prudently invested and will not be squandered through ignorance, bad advice, or frivolity. Third, the income tax that the plaintiff has to pay is usually minimized using a structured settlement. Although tax need not be paid on a lump-sum amount, it does have to be paid on any income resulting from an investment of a lump-sum damage award.
