Under civil demand merchants can “demand” payment for the loss or damage in addition to the
costs associated with the theft under the threat of civil action if the person refuses to pay. They
are basically penalty fees that include the value of the item, in addition to a fee that is calculated
based on the value of the item. Depending upon the state, for example, if the item stolen was
worth $10, the merchant can legally multiply the loss by 10 times its actual value, demanding
$110 from the accused. If the person fails to comply with the civil demand letter, then merchants
can seek civil recovery their losses in a civil court
