Describe three different harms to a fair trial attributed to media publicity.
What will be an ideal response?
Answers should include the following points: (1) Pretrial publicity is believed to contaminate the jury pool, to expose potential jurors to information that may be inaccurate or inadmissible, to increase preconceptions of guilt, to close jurors’ minds to contrary evidence, and to increase the likelihood that attorneys will attempt to “try” the case in the media. (2) Cameras in the courtroom interrupt the process, disrupt the proceedings, and undermine the solemnity of the court, transforming the pursuit of justice into a form of entertainment. (3) Publicity during court proceedings unduly influences participants, intimidating or causing them to alter their answers to questions, distracting attention, and creating a circus atmosphere that leads to grandstanding or shyness.
