It is widely believed that "high-priced" lawyers win cases that other lawyers would lose. The accuracy of this belief is unknown, but even if it is to some extent true, does that make it wrong? In a free market, quality products attract higher prices. The law requires that defendants in criminal cases receive adequate legal representation, not necessarily the best possible attorney. In civil cases there are many differences. Injured victims — rich or poor — can hire top legal talent through the use of contingency-fee agreements. However, rich victims often recover more because they have higher medical bills and more lost income. When fees are hourly, persons less fortunate financially simply cannot afford the services of the most expensive attorneys. On the other hand, poorer persons probably don't become involved in many civil cases, such as corporate mergers and real estate contracts, where the highest legal fees are earned.
