Posner recognized that the contract was not per se invalid, because there could be no presumption that one party was taking advantage of the other. As we found couples entering marriage on a more equal financial footing, we could see that, if it didn’t actually encourage divorce, and if there was full disclosure of each party’s financial picture, the agreement could benefit both parties without doing harm to marriage as an institution.
