Miranda is designed to protect the rights of individuals and to allow them to invoke the right to have an attorney present during custodial interrogation. If the attorney is outside the room, the suspect certainly would benefit from the presence of the attorney before answering incriminating questions, but the police might not be able to successfully interview the suspect to achieve a conviction. There is a tension between the need to catch the guilty party and the need to ensure individual rights are protected. The student should demonstrate an awareness of the tension between these two aspects of criminal justice.
