In 2012, many legal commentators were surprised when the U.S. Supreme Court determined that the penalty imposed by the Affordable Care Act (ACA) on those who did not purchase health insurance was a constitutional tax. Chief Justice John Roberts explained that taxes may be legitimately used by the federal government to encourage behavior. Nothing in the ACA made the failure to purchase insurance a violation of any law; it simply imposed the payment of a tax, collected by the Internal Revenue Service (IRS) like all other taxes, on those who opt to not purchase health care insurance. The fact that the ACA referred to the tax as a penalty did not change the fundamental nature of the payment as a tax.
