The paralegal should keep track of cases on which the paralegal worked at one firm. Then, without breaching client confidentiality, the paralegal should disclose this at the outset of an interview with another firm. This will allow the firm to screen the paralegal if needed (and if allowed), or, at the very least, seek the opposing party’s consent and avoid a disqualification motion.
