What is the effect of an alteration on a negotiable instrument? Does it make a difference whether the alteration was made fraudulently?
An alteration is an unauthorized change that modifies the obligation of any party to the instrument or an unauthorized addition or change to an incomplete instrument concerning the obligation of a party. An alteration that is fraudulently made discharges a party whose obligation is affected by the alteration except where that party assents or is precluded by his own negligence from raising the defense. All other alterations do not discharge any party, and the instrument may be enforced according to its original terms. A discharge for fraudulent alteration is not effective against a holder in due course who took the instrument without notice of the alteration.
