Police interrogations can produce two different types of evidence of out-of-court statements for purposes of the Confrontation Clause, which can have different effects on the admissibility of the evidence:
• They can produce "testimonial" evidence of a crime which the prosecution may seek to use to charge and convict a person of that crime. The 6th Amendment Confrontation Clause applies to "and focuses on" testimonial hearsay. It applies to "witnesses against the accused-in other words, those who ‘bear testimony'.". Davis, 547 U.S., at 823.
• Police interrogations could produce "non-testimonial" evidence. This evidence, though subject to hearsay rules, is not subject to the 6th Amendment Confrontation Clause and can be admitted in a criminal trial if it fits one of the hearsay exceptions discussed in this Chapter.
• A trial judge could rule that some of the evidence from police interrogations is testimonial and some non-testimonial. With testimonial evidence, if a trial adjournment can be obtained a missing witness might be located and persuaded to appear in court and testify, subject to cross-examination. In that case the evidence in question could become part of the record. Police interrogations can produce evidence of out-of-court statements that are offered as evidence, but not to prove the truth of the statements.
