The public fear that the successful use of the insanity defense poses a grave danger because it allows defendants to escape incarceration does not appear to be justified. A very small number of defendants choose to plead not guilty by reason of insanity. Offenders found to be not guilty by reason of insanity rarely obtain their freedom following the verdict. Another limiting factor of the insanity plea is that it is not often used by defendants. it is rare for the plea to be used for any crime other than first-degree murder. If the defendant is found to be not guilty by reason of insanity, the follow-up is that the defendant will be involuntary committed to a mental health institution for an indefinite period of time. The defendant will remain in the mental health institution until medical doctors pronounce him or her not to be a risk to self or community. The defendant could be held in the mental health facility for life.
