The Sixth Amendment of the U.S. Constitution provides that "In all criminal prosecutions, the accused shall enjoy the right to have compulsory process for obtaining witnesses in his favor." The Sixth Amendment also provides that "The accused shall enjoy the right ... to be confronted with the witnesses against him." The witness not only testifies in open court in the presence of the accused but is also subject to cross-examination by the opposing party.
