Diagrams are frequently used at trial. If a witness draws a rough sketch on chart paper while testifying, the judge normally allows the drawing to be used as an illustration but does not allow the drawing to be taken into the jury room during deliberations. Scale drawings that have been properly introduced into evidence can be sent to the jury room.
All of the facts that are the basis for a model or diagram must be admitted into evidence before the visual aide can be introduced. This is true for something as simple as a map of an intersection or as sophisticated as 3-D animation depicting how the crime occurred. Anything shown to the jury must be based on data derived from the facts introduced at trial.
