Four decades after the Supreme Court's decision in Roe v. Wade (1973), abortion remains a controversial issue. How has the Court ruled in cases involving legislative restrictions on abortion?
What will be an ideal response?
Answers will vary. Since the Roe v. Wade decision, the Supreme Court has adopted a more conservative approach and has upheld restrictive state laws requiring counseling, waiting periods, notification of parents, and other actions prior to abortions. Yet the Court has never overturned the Roe decision. In fact, in 1997 and again in 2000, the Supreme Court upheld laws requiring "buffer zones" around abortion clinics to protect those entering the clinics from unwanted counseling or harassment by anti-abortion groups. In 2014, however, the Court ruled that a thirty-five-foot buffer zone established by Massachusetts was excessive. In 2000, the Supreme Court invalidated a Nebraska statute banning "partial-birth" abortions, a procedure used during the second trimester of pregnancy. Despite the lack of federal consensus, in a close and controversial 2007 decision, the Supreme Court upheld the constitutionality of the 2003 Partial Birth Abortion Ban Act.
