Example should indicate that, in a bench trial, the judge is the decider of fact. If the defendant opts for a bench trial, they must (1) waive their right to a jury trial in writing, (2) the state must consent, and (3) the court must approve. A defendant may select this option for cases that are complex or technical or those that involve a stigmatizing event. Bench trials are also much shorter than a trial by jury.
