Melba has recently been hired at a firm that has previously been sanctioned by the state bar association for failing to properly train and supervise its paralegals. All newly hired paralegals are now being required to attend a workshop on ethics. For potential reference in such a workshop, define "ethics;" identify five basic ethical rules governing paralegal conduct; and provide an example of an
ethical conflict that might arise in a family law practice and indicate how it might be addressed.
What will be an ideal response?
Ethics are commonly described as "the standards or rules of conduct to which members of a profession are expected to conform." Paralegal Application 1.7 page 17 of the text identifies 12 ethical rules from which the student can select five. Examples of conflicts are most likely to include issues involving the unauthorized practice of law, conflicts of interest, or confidentiality violations. The remedy will depend on the nature of the conflict identified. For example, if the student uses a conflict of interest as the type of issue that might arise, he or she should discuss an "ethical wall" as a potential means of dealing with the situation.
