Email and text contracts are enforceable so long as they meet the requirements necessary to form a traditional contract, including agreement, consideration, capacity, and lawful object. Traditional challenges to the enforcement of a contract, such as fraud, duress, intoxication, insanity, and other defenses may be asserted against the enforcement of email and text contracts. Email and text contracts usually meet the requirements of the Statute of Frauds, which requires certain contracts to be in writing, such as contracts of the sale of real estate, contracts for the sale of goods that cost $500 or more, and other contracts listed in the relevant Statute of Frauds.
