The Miranda warnings are:
• You have the right to remain silent.
• Anything you say can and will be used against you in a court of law.
• You have the right to have an attorney present during questioning.
• If you cannot afford an attorney, one will be appointed at no charge to assist you during questioning.
The waiver of the Miranda rights must be "knowing, intelligent, and voluntary.". All three of these factors must coincide. In order to have a "knowing" waiver of the constitutional rights, the person must know and understand his/her rights. This is accomplished by giving the Miranda warnings and any explanations that may be needed. "Intelligent" means that the person has the necessary intelligence to understand his/her rights and to make a waiver. "Voluntary" is the opposite of coercion. It is also important that the police do not make promises in order to obtain a waiver.
