The plain-view doctrine recognizes that police officers in the course of their duties will occasionally observe incriminating evidence without a warrant. Given the common situations police respond to, the sighting of objects possibly associated with criminal activity is highly probable. For example, if an officer entered a home in an emergency situation (such as a fire) and observed illicit drugs on a table, the drugs could be seized and used to identify the owner for the purpose of arrest. Therefore, evidence seized in plain view is admissible in a criminal court proceeding.
