Premises liability refers to the legal responsibilities owners or possessors of
land or buildings have toward those who enter the premises. Liability is imposed
if an entrant is injured by a defective premises condition which was (1) latent or
unknown to the entrant and (2) known to the possessor or discoverable by it with
a reasonable inspection. These considerations inform the prime contractor’s
liability as the possessor of the construction site.
