Explain the four-step process used to mark evidence and why the process is required before an item can be admitted into evidence.

What will be an ideal response?

Student responses should include the following steps: showing material to be marked to opposing counsel prior to witness taking the stand to testify; asking the clerk to mark the time for identification purposes; establishing a foundation for the admissibility of the evidence; and making a formal request to admit the item into evidence. Students should discuss the need to authenticate evidence or produce evidence sufficient to show that the item introduced is what the proponent claims it is.
