When a tenant assigns the lease to another party, the tenant is transferring his or her rights to that party for the entire remaining term of the lease. A sublet only transfers a portion of the remaining term to the subleasee. The tenant who assigns the lease gives up any rights to reenter or possess the property, while the tenant who subleases will be permitted to return after the terms of the sublease are completed. In both the assignment and the sublease, the original tenant remains responsible for the payment of rent should the assignee or subleasee not make rental payments to the landlord.
