Students should define direct evidence as any evidence that immediately demonstrates the existence of a fact without inference. Indirect evidence, or circumstantial evidence, should be described as any evidence in which inference and probabilities are needed to draw a conclusion. Examples of direct evidence can be a witness’ testimony saying that he/she saw the crime occur or fingerprints on the murder weapon indicating that the suspect held the murder weapon. An example of indirect evidence is hair found in a suspect's trunk matching the victim's, indicating that the victim could have been there but not necessarily proving that the suspect killed the victim.
