What will be an ideal response?


The rationale for judicial independence is to protect judges and the judiciary from outside control and fallout from unpopular decisions. However, procedures must also be in place to discipline or remove errant judges, because corrupt and wayward judges deface judicial integrity and the public's confidence in the judiciary. Therefore, a delicate balance must be struck in the establishment of procedures and systems to protect the judiciary and the public. Example of the need for judicial independence include the justices in Iowa being removed from office following an unpopular decision regarding same-sex marriage and recent attacks on "activist judges.". On the other side of the issue are judges who engage in judicial misconduct such as jailing defendants without due process or committing crimes while on the bench.
