Explain the voluntary abandonment defense. What do proponents of the defense say to support their argument? What do opponents of the defense say to support their argument? Which side do you agree with? Why?
What will be an ideal response?
According to the voluntary abandonment defense, defendants who voluntarily and completely renounce their criminal purpose can avoid criminal liability. Supporters of the voluntary abandonment defense favor it for two reasons. First, those who voluntarily renounce their criminal attempts in progress aren't the dangerous people the law of attempt is designed to punish; they probably weren't even bent on committing the crime in the first place. Second, at the very end of the progress to completing the crime, it prevents what we most want—the harm the completed crime is about to inflict on victims. Opponents say the defense encourages bad people to take the first steps to commit crimes because they know they can escape punishment.
