5 . The existence and adequacy of the corporation's preexisting compliance program.
6 . Remedial actions, including efforts to implement or improve a compliance program, replace responsible management, discipline or terminate wrongdoers, pay restitution, and cooperate with relevant government agencies.
7 . Collateral consequences of criminal liability, including disproportionate harm to nonculpable persons.
8 . The adequacy of the prosecution of individuals responsible for the corporation's malfeasance.
9 . The adequacy of civil or regulatory remedies.
