Generally common carriers are strictly liable for harm to the bailor's goods. Common carriers are governed by a statute known as the Carmack Amendment. If the goods are delivered to the carrier in good condition and the goods are damaged, the carrier is liable. An exception to this is if the carrier can show that it was not negligent and the goods were damaged by an act of God, such as this tornado.
