Explain the value of language and vocabulary in an interview of a witness, and discuss how best to use “professional jargon” in an interview.

What will be an ideal response?

The language, vocabulary, and communication skills should match the language,
vocabulary, and communication skills of the witness. The paralegal should develop a
comfortable level of dialogue with the witness in order to effectively communicate and
exchange information. The paralegal’s goal is for the witness to be made comfortable with
the interview process using vocabulary at a level specific to the witness’s understanding.
Professional jargon should be used carefully and must be identified and explained to the
witness. Paralegals should be cautious about using legal jargon and technical terms as these
may be confusing to someone with no legal background. For example, if the paralegal tells
the interview subject that she wants to obtain a declaration from him or her, the paralegal
must fully explain the meaning of a legal declaration and what such a declaration entails.
